Rule-Making

Schiff Hardin's environmental attorneys have represented the interests of business and industry in connection with many significant rulemakings, bringing a wealth of unique experience to the rulemaking process. Schiff Hardin attorneys have been involved in rulemaking since the early 1970s when modern national and state environmental law began to be developed. We participated in rulemakings relating to emission standards for new facilities (New Source Performance Standards (NSPS)); the Clean Air Act's national ambient air quality standards (NAAQS); and federal rulemakings to promulgate effluent or treatment and discharge standards for certain specific industrial categories under the Clean Water Act.

We continue that tradition today. In recent years, we have shaped rulemakings for various clients at both the state and federal level, including:

  • The national Clean Air Interstate Rule (CAIR)
  • State rules necessary to comply with the CAIR
  • State rules necessary to comply with the national Clean Air Mercury Rule (CAMR)
  • State rules necessary to comply with Phase II NOx SIP Call reductions as applicable to large, stationary, reciprocating internal combustion engines
