Maxim H. ("Mac") Waldbaum has more than 30 years of experience litigating patents, trademarks, copyrights and trade secret cases.

He focuses on clients in the following industries:

  • Computer hardware
  • Neural networks
  • Pharmaceutical
  • Polymer chemistry
  • Medical devices
  • Nuclear engineering
  • Financial and investment banking

Mr. Waldbaum's lead counsel experience includes complex multi-district litigation involving:

  • All the leading corporations in the video game industry
  • Semiconductor fusing technology
  • Laser bar code patent enforcement
  • Trade dress litigation in luxury goods
  • Trademark litigation protecting the Standard and Poor's S&P 500 trademark against the Commodities Exchange (COMEX)

He also litigates trademark matters in most manufacturing contexts. He was lead counsel in trademark litigation for White-Westinghouse against Westinghouse to protect the White-Westinghouse trademark for all consumer electronic products.

Mr. Waldbaum also has served as an expert witness in cases relating to the computer industry involving:

  • Hardware and software issues
  • Technology contract interpretation
  • Patent validity
  • Infringement
  • Prosecution
  • Inequitable conduct and enforcement
  • Licensing and distribution agreements in multiple technical arts

Mr. Waldbaum founded the Coalition to Advance the Promotions of Sports Logos, an organization comprising professional sports leagues and collegiate licensing to combat counterfeiting worldwide.

He also has served as an arbitrator in the United States on patents, trademarks and trade dress for the World Intellectual Property Organization on Uniform Dispute Resolution Policy for Domain Names since 2000.

Speeches and Presentations

In August of 2007, Mr. Waldbaum gave two presentations in China:
  • A three and a half hour presentation on the latest changes in U.S. patent law to members of the Shenzhen and Hong Kong Patent Law Associations in Shenzhen, China
  • A three hour presentation to the corporate members of Longzhong Industrial Park, 20 to 30 corporate PhD founders of varied technologies, on the need to understand patent laws in the United States as well as the history and practical implementation of such laws
