Nick Kahlon

Associate

Nick Kahlon has successfully litigated a variety of commercial disputes, including:

  • Breach of contract
  • Breach of fiduciary duty
  • Securities
  • Patent
  • Copyright and trademark infringement
  • Lanham Act
  • Discrimination
  • Fraud
  • Deceptive Trade Practices Act claims

Experience

  • Represented a manufacturer of automotive equipment in class action litigation brought by former franchised distributors. Drafted arguments persuading the district court to compel arbitration, then successfully argued motions before arbitrators to deny class relief. In the only individual arbitration to go to hearing, he obtained an award in favor of the client plus attorneys fees.
  • Prosecuted a patent infringement lawsuit on behalf of an international telecommunications company involving nine patents and more than 40 different products. Conducted foreign discovery in Europe and Asia and drafted summary judgment pleadings leading to a highly favorable, multimillion-dollar settlement for the client.
  • Defeated a securities fraud class-action lawsuit brought against a publicly held corporation. Drafted arguments persuading the court to deny class certification and exclude the plaintiffs' damages expert.
  • Successfully defended an international information services provider in a suit brought by competitor for misappropriation of trade secrets. Retained after the competitor had obtained a temporary restraining order against the client, and was able to dissolve key portions of the temporary restraining order and aggressively pursue discovery leading to a cost-of-defense settlement on eve of preliminary injunction hearing.
  • Successfully defended the appeal of an order dismissing the breach of fiduciary duty and consumer fraud act claims brought against an international servicer of commercial loan portfolios.
  • Defended an investment bank in an arbitration brought by a female broker alleging sexual discrimination. Drafted arguments persuading arbitrators to dismiss the broker’s claims of hostile work environment and retaliation.
