Sheldon A. Zabel has principal responsibility for environmental matters for several major utilities and has participated in significant environmental matters on behalf of operating units of numerous companies and other clients of our firm.

Experience

Mr. Zabel's illustrative experiences include:

  • Lead trial counsel for Dynegy Midwest Generation, Inc. (DMG) in defending a suit brought against it as part of the U.S. Environmental Protection Agency's (EPA) Clean Air Act enforcement initiative, alleging DMG violated certain new source review requirements. This is one of the largest air enforcement actions ever brought by the U.S.
  • Principal representation of the Steering Committee at the Rose Chemical Site, Holden, Mo., one of the largest PCB Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) sites in the United States.
  • The Chief Judge of the U. S. District Court for the Northern District of Illinois appointed him Special Master in a complex environmental case pending in that court.
  • Sole arbitrator in a contract dispute between a major coal company and a major utility and was the "partisan" arbitrator for a utility in two coal contract disputes.

Publications

Mr. Zabel has extensively lectured and written in the environmental area.

He has regularly contributed to Natural Resources & Envrionment (NR&E), and his most recent article in that publication was "Utility Enforcement Initiative: Was It Worth It?" (Summer 2006).
