Stephen J. Bonebrake has represented clients before federal and state tribunals in environmental litigation, adjudication and rulemaking matters, such as:
- Private and government cost recovery actions under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA)
- Appeal of the federal Clean Air Interstate Rule (CAIR)
- Participation in the mercury emission and CAIR implementation rulemaking proceedings before the Illinois Pollution Control Board
- Environmental torts
- Water and Resource Conservation and Recovery Act (RCRA) enforcement matters, including alleged failures to obtain wetland fill permits and to comply with RCRA generator requirements
- Clean Air Act enforcement matters, including four of the New Source Review enforcement cases brought by the United States
- Appeals of water and air permits, including Title 5 operating permits
He has counseled clients concerning compliance, governmental investigations and enforcement, environmental audits, permits, site remediations and other matters arising under federal and state environmental programs with respect to various media, including:
- Clean Water Act permits and compliance
- Clean Air Act permits and compliance
- Asbestos abatement and New Source Review emission projections
- Resource Conservation Recovery Act (RCRA) requirements and landfill adjusted standards
- Release reporting
- CERCLA and "voluntary" remediation projects
In addition, Mr. Bonebrake has negotiated and drafted environmental provisions in connection with corporate and real estate transactions, including stock acquisitions and credit transactions. He also has represented clients in litigation matters concerning such provisions.
